Terms of Service

These terms are the agreement between you and Ramon Duran Romaña, Groot Begijnhof 40, 3000 Leuven, Belgium ("Agama", "we", "us") for use of the Agama app. By creating an account or using the app, you agree to them. If you do not agree, please do not use Agama.
Our Privacy Policy explains how we handle your data and forms part of these terms.
1. Your account
You need an account to log observations. You must be at least 16 years old, give accurate information, keep your password to yourself, and tell us at support@agamaapp.com if you think someone else is using your account.
You can delete your account at any time from Settings. We may suspend or close an account that breaks these terms, and we will tell you why unless we are legally prevented from doing so.
2. Your content stays yours
You keep full ownership and copyright of everything you add to Agama — your photos, observations, notes and trips. Nothing in these terms transfers ownership of your work to us.
What we need is permission, and this section sets out exactly how much.
2.1 The public licence you choose
Every photo you upload carries a licence you pick in Settings → Photo licence. It applies to your photos and tells the rest of the world what they may do with them:

The default is CC BY-NC. You can change it at any time, and the change applies to your photos from then on. It does not change the licence on a photo we have already accepted as a species reference image — that licence was fixed at the moment it was accepted, because other people may already have relied on it. See §3.
2.2 The permission you give Agama
Separately from the public licence above, and whichever one you choose, you grant us a worldwide, non-exclusive, royalty-free, transferable licence, with no payment due to you, to host, store, back up, re-encode, resize, crop and display your photos and other content within the Agama app and service, for the purpose of operating and promoting Agama.
In plain terms: this is what lets us show your photo to you, to the people you have allowed to see it, and — if you propose it and we accept it — to everyone, as a species reference image. It also lets us make the technical copies any app must make: thumbnails, the re-encoded version we create when stripping location metadata, backups, and caches.
What this permission does not do. It does not let us sell your photos, licence them to third parties, or use them outside Agama and materials promoting Agama. It does not make your photos public — your privacy settings do that. It does not give us ownership.
How long it lasts. For ordinary photos, this permission ends when you delete the photo or your account; we then remove it from our live systems, and from routine backups within 30 days. For a photo accepted as a species reference image, the permission is permanent, because that image has become part of shared reference data other people rely on, with your name attached to it. See §3.4 if you need such an image taken down.
2.3 What you promise us
By uploading a photo you confirm that you took it yourself, or that you hold all the rights needed to grant the permissions above, and that publishing it will not infringe anyone else's rights or break any law. Do not upload photos taken by someone else, including photos found online, even with credit.
3. Species reference images
Agama shows one reference image per species. Most come from iNaturalist, credited to their photographers. You may propose one of your own photos to replace one.
3.1 How it works
You propose a photo from the species screen. You are asked to confirm you took it, and the licence you have chosen is recorded and frozen onto that proposal. A curator then reviews it and either accepts or declines. You are told either way, and may be given a reason.
3.2 Nothing is automatic
A proposal never becomes a reference image without a person deciding. We are under no obligation to accept any proposal, and we may decline for any reason, including image quality, identification doubt, or simply preferring another photo.
3.3 If accepted
Your photo becomes the reference image for that species for everyone using Agama, including people who are not signed in. It is shown with a credit to you, linking to your profile, and with the licence you granted. We may resize or re-encode it to fit the app. You may withdraw a proposal at any time before it is decided; afterwards, see §3.4.
3.4 Taking one down
If you need an accepted reference image removed — for example because you no longer hold the rights, or for a serious personal reason — write to support@agamaapp.com. We will remove it and revert the species to its previous image. We aim to do this within 14 days, and immediately where the law requires it. Because reference images are frozen in shared data, please treat proposing one as a considered decision rather than a reversible one.
4. Using Agama responsibly
Do not:
- upload photos you did not take, or content you have no right to share;
- post the exact locality of a threatened, protected or heavily collected species — Agama deliberately stores only broad areas, and working around that in notes or place names defeats the point and endangers animals;
- harass, impersonate or abuse other people;
- upload unlawful, hateful or sexually explicit content, or anything unrelated to wildlife;
- scrape, bulk-download, resell or redistribute Agama's data, or attempt to extract the reference database;
- probe, overload or interfere with the service, or try to access other users' data.
There is no tolerance for objectionable content or abusive behaviour. You can report an observation or a person (from the ⋯ menu on an observation, or on someone's profile) and block anyone from their profile. We review reports and remove violating content or accounts, normally within 24 hours.
We may remove content or close accounts that break these rules.
5. Species data is a guide, not an authority
Species names, taxonomy and synonyms come from the Catalogue of Life; checklists and occurrence evidence from GBIF. Whether a species is native or introduced in a place draws on the IUCN Red List, The Reptile Database, Amphibian Species of the World, the Global Register of Introduced and Invasive Species (GRIIS) and, for US states, factual establishment data from iNaturalist. Reference images come from iNaturalist, credited to their photographers. Every source is listed, with its licence, under About → Attributions.
This information is provided in good faith but without any guarantee of accuracy or completeness, and taxonomy changes constantly. Do not rely on Agama for legal, regulatory, conservation, permitting, safety or medical decisions — including whether a species is protected, whether handling it is lawful, or whether it is venomous. Always check the competent authority.
Agama is not a substitute for local wildlife law. You are responsible for knowing and following the rules where you are.
6. Our content
The Agama app, its name, logo, design and code are ours or our licensors'. These terms do not give you any right to use them beyond using the app normally.
Third-party data and open-source components carry their own licences, listed in the app under About → Attributions.
7. Supporter subscription
Agama is free to use, and stays free. Browsing species, logging observations, building your life list, planning trips, exporting your data, and the trip report and share cards are not behind a paywall.
Supporter is an optional paid subscription, and all it does is lift the free tier's usage limits. There are no Supporter-only features: anything Agama can do, a free account can do. The limits that apply to a free account are shown in the app.
We may change those limits over time. If we lower one, we will tell you first, and nothing you have already saved is deleted, hidden or made read-only because of it.
Who you are buying from
Supporter is sold as an auto-renewing subscription through Apple's App Store or Google Play, not by us directly. Payment is charged to your Apple or Google account when you confirm the purchase.
Renewal and cancellation
The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends. You manage or cancel it in your App Store or Google Play account settings. Cancelling stops the next renewal; you keep Supporter until the period you have already paid for runs out.
Price
The current price is shown in the app, in your local currency, before you buy. We may change the price for future periods; where the law or the app store requires it, you will be notified, or asked to agree, before a change takes effect. Any amount shown elsewhere is display-only — the price you actually pay is the one the store shows at purchase.
Refunds
Because Apple and Google are the sellers, refunds are handled under their policies and through them, not by us. If you believe you were charged in error, contact the relevant store; we will help where we can.
If your subscription ends
Nothing you created is deleted and no feature stops working. You keep all your observations, photos, trips and data. The free tier's usage limits simply apply again to anything new you add.
8. Availability and changes
We work to keep Agama running but do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features. If we discontinue the service entirely, we will give reasonable notice and time to export your data.
We may update these terms. If a change is material, we will tell you in the app before it takes effect. Continuing to use Agama after that means you accept the new version.
9. Liability
Agama is provided "as is". To the maximum extent the law allows, we exclude implied warranties and are not liable for indirect or consequential loss, lost data, or loss arising from your reliance on species information.
Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all mandatory rights under the consumer law of your country of residence, and nothing in these terms affects them.
Where liability can be limited, ours is capped at the greater of the amount you paid us in the twelve months before the claim, or €100.
10. Governing law
These terms are governed by the laws of Belgium, and the courts of Belgium have jurisdiction. If you are a consumer resident elsewhere in the EU/EEA or the UK, you may also bring proceedings in your own country and benefit from its mandatory consumer protections.
